RENTAL AGREEMENT AND TERMS AND CONDITIONS FOR

THIS AGREEMENT IS MADE THIS             DAY OF                           2017 BETWEEN THE" RENTERS" LISTED HEREIN AND  LARRY BROADLEY

(HEREINAFTER CALLED "THE OWNER") AND COVERS THE "RENTAL PERIOD" FROM        ___________________2017  TO ___________________ 2017

 

1 : THE FOLLOWING ARE THE NAMES, ADDRESSES ,PHONE NUMBERS  and DRIVERS LICENSE NUMBER OF THE  "RENTERS" (NOT TO EXCEED

EACH OF THE FOREGOING SHALL BE JOINTLY AND SEVERALLY RESPONSIBLE FOR ALL TERMS AND CONDITIONS, STIPULATIONS AND RULES HEREIN..

2 : THE FOLLOWING ARE THE NAMES AND ADDRESSES OF ALL PEOPLE (CHILDREN AND ADULTS ) NOT LISTED ABOVE AND WHO WILL BE OCCUPYING THE

PROPERTY   ( " OCCUPANTS ") AT ANY TIME DURING THE RENTAL PERIOD . THE TOTAL NUMBER OF THE FOREGOING RENTERS AND THESE OCCUPANTS SHALL 

 NOT EXCEED TEN (10) AT ANY TIME .CHILDREN'S AGES ARE REQUIRED.

IN THE EVENT THE NUMBER OF PERSONS ON THE PROPERTY EXCEEDS THE STATED NUMBER ABOVE THE OWNER SHALL HAVE THE RIGHT TO TERMINATE THIS AGREEMENT IMMEDIATELY WITHOUT RECOURSE OR REFUND AND/OR LEVY A $ 200.00 PER PERSON ADDITIONAL CHARGE.

3 : THE RENTAL RATE FOR THE RENTAL PERIOD IS ________________ ALONG WITH ________________SECURITY DEPOSIT. SAID SECURITY DEPOSIT SHALL BE USED TO ENSURE THAT ALL RULES, REGULATIONS AND STIPULATIONS INCLUDING BUT NOT LIMITED TO CLEANING, DAMAGE , REPAIR AND ADHERENCE TO RULES SHALL BE ADHERED TO AND PERFORMED SATISFACTORILY. SAID SECURITY DEPOSIT SHALL BE RETURNED BY CHEQUE WITHIN 14 DAYS OF DEPARTURE IF THERE IS NO BREACH OF THIS CONTRACT. IF DAMAGE BREACH OR CLEANING IS REQUIRED TO BE UNDERTAKEN OR REPAIRS REQUIRED OR ANY OTHER ITEM RESULTING FROM A BREACH OF THIS CONTRACT THEN IT SHALL BE FIRST DEDUCTED FROM THE SECURITY DEPOSIT AND IF INSUFFICIENT THEN EACH RENTER SHALL BE JOINTLY AND SEVERALLY RESPONSIBLE FOR ANY SHORTFALL AND SHALL IMMEDIATELY WHEN CALLED UPON TO DO SO FORWARD SUFFICIENT FUNDS TO THE OWNER WITHOUT RECOURSE TO COVER SUCH SHORTFALL

4 : USE OF THE PROPERTY BY THE RENTERS, OCCUPANTS  AND GUESTS

DURING THE RENTAL PERIOD THE RENTERS OCCUPANTS AND GUESTS SHALL

a :   Maintain the property at all times in a good and tidy condition:

b :  Not smoke inside the property and shall dispose all butts etc outside the property in a safe and tidy manner; There will be a per butt charge if pick up is needed.

c :  Not cause a nuisance in any way, including but not limited to, playing loud music inside or outside the property and specifically shall obey the local noise bylaw that requires no excessive noise at any time. Any fines or charges levied are the sole responsibility of the Renters and may also result in Termination.

d : Respect the neighbours and not do anything that shall cause a nuisance including the aforementioned noise regulations, parking and any other activity that can be deemed annoying. The Renters, Occupants and Renters" guests shall not do anything on the property that is illegal.

e :  Properly use and operate all equipment , machinery and appliances at the property

f :  Not move or re-arrange furniture inside the property nor take any furniture inside to the outside

g :  Not flush sanitary items or any other item that might obstruct, down the toilet

h :  Not sit on the furniture in wet clothing and ensure that sand is removed before entering the property

i :  Comply with all applicable laws and bylaws in connection with their use of the property

k : Properly place all garbage and waste and recycling in the designated bins on the west side of the building. The Renters shall ensure that their garbage is placed in the bin as the neighbourhood animals will get into and the Renters shall be responsible for any mess or damage if it shall occur. No garbage or Recycling shall be left in the Rental Premises.

l :  Not bring or allow any pets of any type on the property at any time.

m : Not have a fire of any type anywhere on or near the property except in the provided fire place as long as the flames are reasonably kept within the confines of the fireplace. The fireplace is not to be moved.

n : Leave the property in the same condition of cleanliness in which they find the property noting that cottage cleaning is not included in the rent and it is the Renters responsibility to do a thorough cleaning of the property inside and out prior to departure. Cleaning materials are supplied.

5 : The renters and other occupants named herein shall indemnify and save harmless the Owner  from and against any liabilities or any loss or damage whatsoever arising from, related to or in connection with the use and rental of the property including but not limited to, any claim for liability for personal injury or damage or loss of property which is made, incurred or sustained by the Renter , guest or occupant at the Property during the Rental Period

6 : The owners warrant that their failure to supply the cottage with hydro, water or by reason of fire erosion, storm damage, insurance cancellation or non renewal beyond their reasonable control will result in the refund of the rent paid by you for the days not used and save and except for such refund the Owners make no other warranty with respect to the premises. In the event the Property is damaged materially prior to the Rental Period, this Contract shall be null and void and all payments received by the Owner hereunder shall be returned to the Renter. The Owner does not guarantee the operation of any piece of equipment, machinery or appliance serving the property, and there shall be no discount to or refund of any portion of the Rental Rate for failure, during the Rental Period, of any piece of equipment appliance or machinery serving the Property

7 : The Owner shall be entitled to terminate this contract without recourse or refund if the Renter, Occupants, or any of the Renters guests are in violation of any of the Terms of this contract or, in the sole opinion of the Owner, if the Renters, Occupants or Renters guests" use of the Property is detrimental to the Property ,creates a nuisance in any way or is illegal. The Owner shall be entitled to access the Property without notice during the Rental Period for the purposes of supplying services effecting maintenance or repairs and performing inspections.

8 : The Owner shall provide parking on the property for up to 3 cars and provide overnight street parking passes for 2 cars. The passes are the responsibility of the Renters and shall be returned at the end of the Rental Period. Lost or misplaced passes are subject to a  replacement fee off $ 75.00 each.

9 : The Renter shall report any damage to the Property upon arrival or occurrence. The Renter shall be responsible for any damage which occurs during the Rental Period.

10 : The Owner shall inspect the Property after the Renter's departure and shall advise the Renter of any damage or replacements in respect of which the Renter is required to reimburse the Owner. Such items will be charged according to repair or replacement value at time of such repair or replacement, as determined by the Owner.

11 : Keys for the Property will be handed to the Renter at the time of arrival. The Keys may be used by the Renter to access the Property during the Rental Period. The Renter shall ensure the Property is properly secured during the Rental Period. Keys are to be returned at the end of the Rental period as designated at arrival. Lost or misplaced keys are subject to a replacement charge of $ 20.00 each.

12 : The Renter consents to the Owner obtaining any information about the Renters as the Owner may deem necessary at any time in connection with this contract, or matters arising therefrom. The Renter further consents to the Owner disclosing any information concerning the Renter to any credit reporting agency. The Renter acknowledges that personal information provided by the Renter to the Owner will only be used for the purpose of this rental contract. The foregoing acknowledgements and consents are made by each party named as Renter herein.

13 : All Rent and Security Deposit shall be fully paid prior to occupancy of the Property.

50% of the Rent is required within 7 days of booking by regular cheque (if 45 days ahead of Rental Period.) The balance  of the Rent and Security Deposit is due on arrival in cash or certified cheque, or by  cheque  received no later than 30 days prior to arrival.

Cancellations will only be refunded ( less an Admin fee ) if notice is received not later than 60 days in advance of the Rental period

 

We the Renter's have fully read and understood all the terms, conditions, rules and regulations contained herein concerning the Rental Property and agree to abide by them jointly and severally as contained in all  pages of this agreement..
